New employer duties: Preventing workplace sexual harassment
As of 26 October 2024, the Worker Protection (Amendment of Equality Act 2010) Act 2023 imposed a new proactive duty on employers to take “reasonable steps” to prevent sexual harassment in the workplace — including temporary staff and contractors. Without these ‘reasonable steps’ a tribunal could put a 25% uplift on any successful claim.
In a climate where:
- 37% of people have experienced sexual harassment at work or place of study
- Which goes to over 50% if we look at harassment solely directed at women
it’s not only a legal duty, but an ethical duty for employers to do whatever they can to reduce this.
Prevention is not just about policies and processes, it’s through training. Training which won’t just help everyone think differently about sexual harassment, but about the fundamentals of good communication and respect in the workplace, ensuring people behave appropriately without creating a culture where everyone is walking on eggshells.
